TERMS AND CONDITIONS FOR BOOKING CLASSES AT KINGS CROSS STUDIOS

These terms and conditions apply to all users of Kings Cross Studios. They contain important information relating to our limitation of liability, cancellation and privacy policies. Please read them carefully before making a booking.

BOOKING

Class courses are valid for 6 months from the date of purchase. They are non-transferable and non-refundable

CANCELLATION

Kings Cross Studios operate a 24 hour cancellation policy. If you cancel at least 24 hours prior to the day of your class, you will not be charged. Cancellations made less than 24 hours prior to the day of your class will incur a charge equivalent to the full cost of the cancelled class.

Any cancellation charges will be taken using the credit/debit card used to secure the booking where applicable. By making a booking, you agree to our cancellation policy.

LIMITATION OF LIABILITY

Kings Cross Studios agree to compensate you for any loss or damage you may suffer if we fail to carry out our obligations to a reasonable standard or breach any obligations imposed on us by law and cause death or personal injury to you by our negligence. However, we will not be liable to you if that failure is attributable to any of the following:

  • Your fault including your misuse of the Equipment;
  • The fault of a third party unconnected with our provision of services to you at Kings Cross Studios;
  • Events which we have no control over, could not have foreseen or forestalled even if we had taken reasonable care; or
  • Faults in the Equipment which we or our suppliers have no control over, could not have foreseen or forestalled even if we had taken reasonable care.

Our liability to compensate you in the event of loss or damage other than death or personal injury is limited to a reasonable amount having regard to such factors as whether the damage was due to a negligent act or omission by us.

You agree to use the Equipment safely, in accordance with your training and any specific instructions provided by us or the manufacturers of the Equipment.

You agree to compensate us to the cost of the replacement or repair of the Equipment if it is damaged by an act of your negligence whilst using it.

PRIVACY NOTICE

This is the Kings Cross Studios Privacy Notice. It contains information on how we collect and process personal data.

Who we are

Kings Cross Studios is a brand owned by Kings Cross Studios Limited whose registered office is located at 154 Caledonian Road, London, London, N1 9RD, registered in England under Company number 06525214.

Our studios, including our Pilates, Gyrotonic and Gyrokinesis studios are located at 154 Caledonian Road, London, London, N1 9RD (“The Studios”).

Personal data we collect

When carrying out our services we may collect and process the following data about you:

  • Contact details including name, address, email address;
  • Records of your correspondence with us;
  • Data about your health and fitness;
  • Data about your lifestyle interests;
  • Details of any visits you make to our website or Studios;
  • Media files including images and video footage;
  • Information you give in feedback surveys about our services; and
  • Any other information you provide us with including details of disability and or other information relating to health and safety and use of our equipment.

Contact and identification

When you access our website or visit the Studios we will keep a record of your name, postal and email addresses, telephone number(s) and any contact preferences.

When you join us and become a member we record your date of birth and gender. We will store your username and password if you register with us via our website.

We will keep a record of any joining documents you complete including our application form, photograph and policy documents.

If you pay by card or direct debt we will keep a record of your payment and bank details.

Payment

If you pay for goods and services at the Studios by card we record your payment card details.

Attendance

If you use our website (www.kingscrossstudios.co.uk) we record information about the URL you came from, your device’s IP address, your browser type and information about where your device is located. We may capture your image on CCTV when you visit the Studios.

Correspondence and incidents

If you contact us in writing we may keep a record of that correspondence. If you provide feedback or complete a survey about our services we may keep your comments.

If you are involved in an incident at the Studio we will keep a record of the incident.

How we use your data

We may use your personal information for the following purposes:

In the provision of our services and for administrative purposes;
In order to comply with applicable laws and regulations;
To deal with enquiries online and at the Studio;
To provide you with information about us and our services.

Who we may share your data with

We respect your privacy. We will not sell your information to any third parties under any circumstances.

We may give information about you to the following third parties:

We may share your personal information with third parties if we are under a duty to in order to comply with any legal obligation.
We may share data with our agents, contractors and employees to provide our services and administer your membership.
We share your card and bank details with our secure payment providers to process card transactions and direct debit payments.

How long we keep your data

We keep the information that you provide or that we collect only for as long as we need to in line with the reason it was collected.

Your rights

Under the GDPR, you have a number of rights that you can exercise in certain circumstances. These are free of charge. In summary, you may have the right to:

  • Ask for access to your personal information and other supplementary information;
  • Ask for the correction of mistakes in your data or to complete missing information we hold on you;
  • Ask for your personal information to be erased, in certain circumstances;
  • Receive a copy of the personal information you have provided to us with or have this information sent to a third party. This will be provided to you or the third party in a structured, commonly used and machine readable format, e.g. a Word or PDF file;
  • Object at any time to us processing of your personal information for direct marketing;
  • Object in certain other situations to the continued processing of your personal information;
  • Restrict our processing of your personal information in certain circumstances;
  • Request not to be the subject to automated decision-making which produces legal effects that concern you or affects you in a significant way.

  • Use the contact details at the end of this document;
  • We may need to ask you to provide other information so that you can be identified;
  • Please provide a contact address so that you can be contacted to request further information to verify your identity;
  • Provide proof of your identity and address;
  • State the right or rights that you wish to exercise. We will respond to you within one month from when we receive your request

Marketing Emails

Please note if you wish to unsubscribe from any marketing emails that you have previously received and/or signed up for, you can do so by emailing: tisha@kingscrossstudios.co.uk.

Please note it may take up to 30 days for this to become effective.

How to make a complaint?

The GDPR also gives you the right to lodge a complaint with the Information Commissioners’ Office if you are in the UK, or with the supervisory authority of the Member State where you work, normally live or where the alleged infringement of data protection laws occurred. The Information Commissioner’s Office can be contacted at http://ico.org.uk/concerns/.

Future Processing

We do not intend to process your personal information except for the reasons stated within this privacy notice. If this changes, this privacy notice will be amended and placed on the website.

Changes to this privacy notice

This privacy notice was published on 22nd June 2020. We continually review our privacy practices and may change this policy from time to time. When we do it will be placed on the website
